SENATE CONCURRENT RESOLUTION 66

Requesting the Joint Committee Government and Finance study the potential benefits and detriments of establishing medical malpractice peer review panels by the Board of Medicine.

Whereas, The Legislature finds a need to study the potential benefits of establishing physician review panels for medical professional liability actions in West Virginia;

Whereas, Eighteen other states have established a similar procedure in varying forms;

Whereas, The form and function of medical peer review panels and the potential advantages and disadvantages warrants consideration and study;

Resolved by the Legislature of West Virginia:

That the Committee on the Judiciary is hereby requested to study the potential benefits and detriments of establishing medical malpractice peer review panels by the Board of Medicine; and, be it

Further Resolved, That the Joint Committee on Government and Finance report to the regular session of the Legislature, 2018, on its findings, conclusions and recommendations, together with drafts of any legislation necessary to effectuate its recommendations; and, be it

Further Resolved, That the expenses necessary to conduct this study, to prepare a report, and to draft necessary legislation be paid from legislative appropriations to the Joint Committee on Government and Finance.
